Terms of Service

These Terms of Service ("Terms") govern your use of Piccard, a vocabulary and flashcard web application available at piccard.app (the "Service"). The Service is operated by Piccard ("Piccard," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Description of the Service

Piccard is an AI-assisted language-learning application that helps you create and review vocabulary flashcards. When you submit a word, phrase, or photo, the Service uses a third-party artificial intelligence model to generate flashcard content, which may include translations, definitions, example sentences, pronunciations, and language-specific metadata. You can then study the generated cards using a spaced-repetition review system.

The Service is provided as a progressive web application (PWA) accessible through a web browser.

2. Eligibility

You must be at least the age of digital consent in your jurisdiction (13 years old in most regions) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Piccard does not knowingly collect personal information from children below the applicable minimum age. If you believe a minor below that age has provided personal data to the Service, please contact us and we will delete it.

3. Accounts

3.1 Account types

The Service offers two ways to access your account:

  • Device-based access. When you first use the Service without signing in, a unique anonymous identifier is assigned to your device. Your cards and review history are associated with this identifier. You do not need to provide an email address or password for this mode.
  • Google account. You may optionally sign in with a Google account via Google OAuth. This links your Google account to your Piccard account and allows you to access your cards across devices.

3.2 Device merge

If you start with device-based access and later sign in with Google, your existing cards and review history can be merged into your Google-linked account so that no data is lost.

3.3 Your responsibilities

You are responsible for:

  • Maintaining the security of your device and any linked Google account.
  • All activity that occurs under your account or device identifier.
  • Notifying us of any unauthorized use of your account.

Piccard is not liable for any loss or damage arising from unauthorized access to your device or linked Google account. You may request account deletion at any time by contacting us.

3.4 One person per account

Each account is intended for an individual person. You may not share, transfer, or sell your account credentials or device identifier to another person.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Submit content (words, phrases, or images) that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, or that infringes the intellectual property or privacy rights of any third party.
  • Attempt to disrupt, overload, or impair the Service, including by circumventing rate limits, generation quotas, or other usage controls.
  • Scrape, crawl, or systematically extract data or AI-generated output from the Service at scale.
  • Resell, sublicense, or redistribute access to the Service or the AI-generated flashcard content as a commercial product.
  • Reverse-engineer, decompile, or otherwise attempt to extract the underlying AI model, prompts, or proprietary logic of the Service.
  • Introduce malware, viruses, or any other malicious code to the Service.
  • Use automated scripts, bots, or other automated means to access the Service, except as permitted by standard browser navigation.

The Service enforces rate limits and generation quotas to ensure fair availability for all users. Violation of these limits or any of the above restrictions may result in suspension or termination of your access to the Service, as described in Section 10.

5. AI-Generated Content Disclaimer

This is the most important section of these Terms. Read it carefully.

The flashcard content generated by the Service is produced by a third-party artificial intelligence model. AI-generated content may be inaccurate, incomplete, outdated, inappropriate, or biased. You must independently verify the accuracy and appropriateness of all AI-generated content before relying on it, sharing it, or using it in any educational, professional, or personal context.

Piccard does not guarantee that:

  • Translations, definitions, or example sentences will be correct or natural.
  • Pronunciation guides (IPA, pinyin, romaji) will be accurate.
  • Grammar or usage notes will reflect current or correct usage.
  • The content will be free of errors, omissions, or bias.

The Service and its AI-generated content are not a substitute for professional language instruction, translation services, or educational advice. Piccard is not liable for any decisions, actions, or outcomes resulting from your use of or reliance on AI-generated content.

6. User Content and Licenses

6.1 Your content

"You Content" means the words, phrases, text, and images that you submit to the Service for flashcard generation. You retain ownership of your User Content.

6.2 License to Piccard

By submitting User Content, you grant Piccard a worldwide, non-exclusive, royalty-free license to process, transmit, and store your User Content for the purpose of providing the Service. This includes sending your input to the third-party AI model for processing and storing the resulting flashcards and any uploaded images in our infrastructure.

6.3 Responsibility for your content

You represent and warrant that:

  • You own or have the necessary rights to all User Content you submit.
  • Your User Content does not violate any law or the rights of any third party.
  • You have obtained any consents needed for images you upload (e.g., consent of identifiable individuals).

Piccard reserves the right to refuse processing, remove, or delete User Content that we believe violates these Terms or applicable law.

7. Intellectual Property

7.1 The Service

The Service, including its software, design, features, and underlying infrastructure, is owned by Piccard and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use the Piccard name, logos, or branding.

7.2 AI-generated card content

Flashcard content generated by the Service is produced by a third-party AI model. Piccard grants you a personal, non-commercial license to use, study, and modify the flashcards generated under your account for your own language-learning purposes. You may not use AI-generated card content to build a competing product or service.

8. Free Tier and Pro Subscription

8.1 Free tier

The Service offers a free tier at no cost. The free tier includes up to 5 AI generations per day. A "generation" is one call to the AI model, regardless of how many flashcards (1 to 5) are produced in that call. Reviews of existing cards are unlimited. Unused generations do not roll over to the next day.

8.2 Pro subscription

The Service offers a Pro subscription for $4.99 per month. The Pro tier includes up to 1,200 AI generations per month. Reviews of existing cards are unlimited. Unused generations do not roll over to the next month.

8.3 No trial

The Service does not offer a free trial of the Pro tier. You will be charged the full monthly price upon subscription.

8.4 All language pairs included

Both the free tier and the Pro subscription include access to all available language pairs. There are no language-pair-specific upgrades or restrictions.

9. Payment and Billing

9.1 Stripe

All payments for the Pro subscription are processed through Stripe, a third-party payment processor. Piccard does not store your full credit card or payment card details. Your payment is governed by Stripe's terms and your agreement with your payment provider.

9.2 Recurring billing

The Pro subscription is a monthly recurring subscription. Your payment method will be charged automatically each month until you cancel. You can manage or cancel your subscription at any time through the Stripe Customer Portal accessible from within the Service.

9.3 Cancellation and refunds

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period — you will retain Pro access until then. For refund information, please see our Refund Policy.

10. Service Changes and Suspension

10.1 Modifications

Piccard may modify, update, or discontinue the Service, or any feature thereof, at any time and without notice. We may also change pricing, quotas, or tier features with reasonable advance notice posted in the Service or sent to the email associated with your account (if any).

10.2 Suspension and termination

Piccard reserves the right to suspend or terminate your access to the Service if you violate these Terms or if your use of the Service poses a risk to the Service, other users, or Piccard. We may also terminate or suspend access for operational reasons, including maintenance, security, or capacity concerns.

10.3 No obligation to store

Upon termination of your account, Piccard may delete your account data, including cards, review history, and uploaded images. Piccard is not responsible for any data loss following account termination.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Piccard disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Consumer rights. Nothing in these Terms excludes, restricts, or modifies any non-excludable guarantees, rights, or remedies you have under applicable consumer-protection law. Where a non-excludable consumer guarantee applies and we are permitted by law to limit our liability for a failure to comply with that guarantee, our liability is limited, at our option, to resupplying the Service or paying the cost of having the Service resupplied.

Piccard does not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • AI-generated content will be accurate, reliable, or complete.
  • Defects or errors will be corrected.

12. Limitation of Liability

To the fullest extent permitted by law, Piccard and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service.

In any case, the total liability of Piccard for any claim arising out of or related to these Terms or the Service shall not exceed the amount you have paid to Piccard in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

13. Indemnity

You agree to indemnify and hold harmless Piccard and its affiliates, officers, employees, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing Law and Dispute Resolution

These Terms are governed by applicable law, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the courts of competent jurisdiction.

15. Changes to These Terms

Piccard may update these Terms from time to time. We will post the updated Terms in the Service and update the "Last updated" date above. If the changes are material, we will provide notice in the Service or by email (if you have provided an email address). Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
